This notice explains how Whitespace AI, Inc. ("Whitespace", "we") collects and uses personal data when you visit our website, contact us, sign up for our product, or otherwise interact with us. We are the controller of the personal data described below.

Phone numbers and SMS messaging
This section explains how Whitespace collects and uses telephone and mobile numbers, and how we handle consent to receive text messages. It applies to our own messaging programme. It is the privacy statement referred to at the point where you consent to receive messages from us.
How we collect your mobile number
We only collect a mobile number when you give it to us. That normally happens in one of the following ways: you enter it in a form on our website or in a document we send you; you give it to us in an email, on a call, or in a meeting; you include it in a booking you make with us; or your employer provides it to us so that we can support your use of the Whitespace product. We do not buy mobile numbers, and we do not obtain them from lead lists, data brokers, or other third parties for the purpose of sending messages.
Consent to receive text messages
We send SMS or MMS messages to a mobile number only where the person who holds that number has given prior express written consent to receive them. Consent is given by an affirmative act, such as ticking an unticked consent box on a form or replying to confirm by text. Consent is never a condition of buying anything from us, and we do not treat a mobile number given for one purpose, such as a call about your account, as consent to receive marketing text messages.
We keep a record of each consent, including the mobile number, the date and time, the wording you agreed to, and where the consent was given. We keep that record for as long as we may message you and for at least four years after your last consent or opt-out, so that we can evidence compliance.
What we use it for
We use telephone and mobile numbers to reply to you when you contact us, to arrange and confirm calls and meetings, to send account, service, and security notifications relating to your use of the Whitespace product, and, where you have separately consented to marketing messages, to send occasional product news. Message frequency varies. Message and data rates may apply.
Opting out
You can stop text messages at any time by replying STOP to any message we send you. We will send one confirmation message and then stop. Reply HELP for help, or contact us at team@whitespacehq.ai or +1 (203) 429-9839. Opting out of text messages does not opt you out of email, and does not affect your use of the Whitespace product. Full messaging terms are set out in our Terms of Service.
We do not share mobile information
No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. All of the data categories described in this notice exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, with the sole exception of the aggregators and messaging providers we use to deliver the messages you have asked to receive, who may not use it for any other purpose.
Customer data
When customers use Whitespace, we process personal data contained in their orders, invoices, contacts, and other business records on their behalf and under their instructions. This notice does not cover that processing. Please contact your employer or the relevant Whitespace customer for their own privacy notice.
Sharing
We share personal data only with: service providers who help us operate (see Sub-processor List); professional advisers under confidentiality; authorities where required by law. We do not sell personal data. Text messaging originator opt-in data and consent are excluded from all sharing described here, other than with the messaging providers who deliver the messages, as set out under "Phone numbers and SMS messaging" above.
International transfers
Whitespace's primary customer data storage is hosted in the EU. Specific processing functions (including AI inference, authentication, and certain analytics) are performed by sub-processors located in other jurisdictions, including the United States. Where service providers we use are based outside the country where you are located, we rely on appropriate transfer mechanisms, which may include the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, the EU Standard Contractual Clauses, and the EU-US Data Privacy Framework (and its UK Extension), depending on the transfer.
Retention
We keep personal data only as long as needed: customer account data for the term of the contract plus 12 months; prospect contact data until you ask us to delete it or for up to two years after our last interaction; marketing data until you unsubscribe; SMS consent and opt-out records for at least four years after your last consent or opt-out, so that we can evidence compliance; records required for legal reasons (e.g. tax) for the period required by law.
Your rights
Depending on your location, you may have rights regarding your personal information, including the right to access, correct, delete, or port your data. To exercise these rights, contact us at team@whitespacehq.ai.
You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional email, or by replying STOP to any text message. Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy.
Right to lodge a complaint. If you are in the United Kingdom, you have the right to lodge a complaint with the Information Commissioner's Office at ico.org.uk. If you are in the European Economic Area, you have the right to lodge a complaint with your local data protection supervisory authority. If you are in the United States, you may have rights under state privacy laws (including the California Consumer Privacy Act for California residents); please contact us at team@whitespacehq.ai for further information.
